By accessing or using TupicAnalytics (the "Service"), operated by Mirrage IT Solutions ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
These terms apply to all users including API consumers, dashboard users, and paying subscribers.
TupicAnalytics is an AI-powered media intelligence platform that provides automated content analysis through a REST API and web dashboard. Services include but are not limited to:
We reserve the right to modify, update, or discontinue any feature of the Service at any time.
To use the Service, you must create an account and may generate API tokens for programmatic access. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms, generate excessive load, or remain inactive for extended periods.
Your Content: You retain ownership of all media files you upload to the Service. We do not claim ownership of your content.
License Grant: By uploading content to the Service, you grant us a limited, non-exclusive, worldwide license to process, analyze, store, and generate derivatives (such as thumbnails, embeddings, fingerprints, and metadata) of your content solely for the purpose of providing the Service.
Data Utilization: We reserve the right to use anonymized, aggregated, and non-identifiable data derived from your content (such as statistical patterns, model performance metrics, and aggregate usage data) to improve and train our AI models, enhance the Service, and conduct research. No personally identifiable information or original content will be shared externally.
Content Responsibility: You represent that you have all necessary rights and permissions to upload content to the Service. You are solely responsible for the legality of your uploaded content.

No Guarantee of Accuracy: The Service uses machine learning models to analyze media content. AI-based analysis is probabilistic by nature and we do not guarantee the accuracy, completeness, or reliability of any analysis results, including but not limited to:
Not a Substitute for Human Review: Analysis results are provided as automated suggestions only. You should not rely solely on the Service for content moderation, legal compliance, copyright enforcement, or any critical decision-making. Human review is always recommended.
False Positives & Negatives: AI models may produce false positives (flagging safe content as unsafe) and false negatives (failing to flag unsafe content). We accept no liability for any consequences arising from incorrect classifications.
Model Updates: We may update, replace, or retrain AI models at any time. This may cause analysis results for the same content to change over time. Previous results are not guaranteed to remain consistent.
Nature of Registration: Content that meets eligibility criteria (unique, non-NSFW, below similarity threshold) may be registered on TupicChain. Registration records a cryptographic hash, timestamp, and owner address on the blockchain.
Not Legal Proof: Blockchain registration provides a timestamped record of content submission. It does not constitute legal proof of copyright, ownership, or intellectual property rights. It is not a substitute for formal copyright registration with relevant authorities.
Immutability: Once registered on the blockchain, records cannot be modified or deleted. You acknowledge this before opting in to blockchain registration.
Eligibility: We determine eligibility criteria at our sole discretion and may modify thresholds and rules at any time without notice.

Each plan includes specific API call limits and upload quotas. Exceeding your plan's limits may result in:
We reserve the right to impose additional rate limits to protect service stability.
Free Plans: Developer tier accounts are provided at our discretion and subject to usage limits. We may modify or discontinue free plans at any time.
Paid Plans: Paid subscriptions are billed in advance monthly. All fees are non-refundable unless otherwise stated.
Usage Overage: For plans with usage-based pricing, overage charges are calculated based on actual consumption and billed at the end of each billing cycle.
Price Changes: We will notify subscribers at least 30 days before any price increase. Continued use after the effective date constitutes acceptance.
Processing: Uploaded content is processed by our AI models on our infrastructure. Files may be temporarily stored during analysis and retained according to your plan's storage policy.
Derived Data: We generate and store derived data from your content including fingerprints, embeddings, thumbnails, metadata, and analysis results. This derived data is used to provide the Service and may be retained after original file deletion.
Security: We implement commercially reasonable security measures including encryption in transit (TLS), access controls, and infrastructure isolation. However, no system is completely secure and we cannot guarantee absolute security.
Data Location: Data is processed and stored on servers in the United Arab Emirates (AWS me-central-1 region). By using the Service, you consent to data processing in this jurisdiction.
Data Deletion: You may request deletion of your uploaded content and associated data. Blockchain registrations cannot be deleted due to the immutable nature of the blockchain.
The Service, including its algorithms, AI models, APIs, code, design, and documentation, is the intellectual property of Mirrage IT Solutions and is protected by applicable intellectual property laws.
Your subscription grants a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This does not grant rights to our models, source code, or underlying technology.
To the maximum extent permitted by applicable law:
Specifically: We accept no liability for content that is incorrectly classified as safe or unsafe, for blockchain registrations of content that later proves to be infringing, or for any business decisions made based on ad intelligence or analysis outputs.
By You: You may close your account at any time. Upon termination, your API tokens are immediately revoked.
By Us: We may suspend or terminate your account for Terms violations, CSAM uploads, abuse, or as required by law.
Effect: Upon termination, you have 14 days to export your data via the API. After this period, we may permanently delete all associated data. Blockchain registrations persist permanently.
We may revise these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 14 days before taking effect.
Continued use after changes become effective constitutes acceptance. If you disagree, discontinue use of the Service.
These Terms are governed by the laws of the United Arab Emirates, specifically the Emirate of Dubai. Disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
